I ordered a cheap Hori brand d-pad joycon off ebay. It was listed as new, upon receiving the controller, I see that the controller's package has been previously opened. I haven't tried it out yet to see if it has the drift. I also haven't contacted to seller about this, since I had to ask if there was something preventing them from shipping the product.

Should I contact them before giving them neutral or negative feedback, saying something like "item was listed as new, arrived previously opened"?
 
If it has the drift I'd give them a negative, but if not I'd give them a neutral. Was the item description listed as new and unused, or just new? A lot of times a product is just tried out, but still qualifies as new for people.
 
I'd also contact the seller first and see what they say. In my experience, they're usually pretty good with working with buyers.

I sent a message saying "The item was listed as new, it arrived previously opened". They responded with three messages:

-"New, doesn't have close sticker".
-"Or Tape".
-"I never used it".

It is originally sealed with circular tape, which is how I could tell it was opened. There is no drift yet. I'm leaning toward neutral or positive feedback since it works, even if they are being weird about it.
 
There shouldn't be neutral feedback, just positive or negative. This person lied so they should get negative feedback, especially since they're doubling down.

They get negative feedback and either straighten out, or others also leave negative feedback since this seller is shady and then ebay kicks them off.
 
I only received items I’ve bought damaged from shipping three times out of the dozens of purchases I’ve made on the site. At one point I was spending over $100 per month on things I bought on eBay but I’ve dialed it back by a lot since then. And I’ve only had the postal service lose one purchase which I was able to get a refund because I had proof of it being mailed out via confirmation number provided by the seller and confirming with said seller about it being shipped out. After a month, I still hadn’t gotten the item and I filed a claim which went well and the seller was nice about the situation and happy that we resolved the problem.
 
Do you still want it? Test it out to make sure it works fine. And if you're not satisfied because it looks like the controller has wear, is dirty and clearly used, or has drift, you can send it back.

You can get Ebay involved. Be sure to screenshot the listing with the 'new' bit in case they somehow change it. Then get them involved with item as not described and you can get a refund if you send it back. The seller will have to foot the shipping bill and send you shipping label on their expense. If they try to weasel out of that, you can go back to Ebay to show proof of that. Document their messages.
 
If they advertised it as open box / opened but product unused.. then I don't see a problem and would just leave it like that. Since that is what was advertised.

However, if they advertised it as unopened and new in package then I would take it up with the seller and eBay. If they are weird about it and have bad customer service*, then I'd consider giving them a negative review.
*(if they don't give me a refund or a chance to return it.)
