You don't have to be actively using them, but they have to be attached.

It’s about which joy cons are attached / were last attached to the Switch. If the OP is using a different colour of joy cons other than the ones that came with the Switch, they may not receive the gift.

I don't have the special edition switch irl, but I bought it from the ABD, so maybe try checking that every day?
