I need some advice about my nintendo.

Ok, so I sent my Nintendo 2ds xl to Nintendo for repairs since the battery only lasts 5 hours -unplayed, in sleep mode- they say it's a power connector issue, 'physical damage' and my warranty doesn't cover physical damage; but they can, however repair it for $50 +s/h=$13.

I don't think I can afford that right now, so I was going to have them just send it back but when I click that option, this pops up:
"Important! If your system is returned unrepaired, we will not be able to recover or transfer any game save data or virtual content (Eshop or Wiishop downloads). To have this data transferred, you must select the "Repair my System" option."

So what I'm gathering is, that they are literally holding my data hostage unless I pay $60.

They confirmed that it had arrived at 8:34 this morning, they sent me the unrepairable email at 9:45, they had my nintendo for an hour and a fifteen minutes.

So my dilemma is what to do now, I have until the 29th to respond either way or they'll send it back.

I found a new orange (which is they color I really wanted) system for $130 on ebay, I can't afford that really either but I'd rather pay that for a new one than $60 to repair one , and then transferring dses and possibly sell mine at a game store or something, so it won't take that big of bite out of my extra finances. (like $300, I'm a wealthy miser :/)

But as I said they have all my data! I know that it's all linked to my nintendo profile but still.

I'm leaning more towards buying a new one:
Option 1: I bought my ds for $164, I could pay $63 to have it repaired = $230
Option 2: I bought my ds for $164, I could buy a new one for $130 = $290 and sell mine for (lets say) $90 (idk, seems to be what they're going for) = $200

for a $30 difference, it kinda seems like a wash to me, so please advise me, what to do, what do used 2ds xl s go for?

Do you have a lot of games downloaded from the eshop? Then get it repaired in my opinion
 
I still have my old DSi and I can't play it without it being on the charger. If I play it off the charger, even on a full battery, it shuts itself off. Allegedly, this happened from my keeping it on the charger whenever I wasn't playing on it or traveling with it. I dunno if the whole "Playing a system while it's charging destroys the battery" or "You overcharged your battery" things are true or not, however, consider this:

It's possible the issue could stem from something such as overcharging your system, which IF that turns out to be a real thing, could mess up the battery. In that case, I would recommend asking them about things like that. My guess they've already discovered physical damage, but if there's a chance it's something that is covered by warranty, I think it wouldn't hurt to have them double check.

But if it turns out the warranty can't cover the repairs...well take it from someone on a horrible budget. Sixty dollars for repairs fees and shipping sounds like a better alternative then paying close to 200 for a replacement system.
 
I'm just going to have it shipped back, I'm not getting it repaired and I'm going to deal with whatever it does or doesn't have on it.
I'm not worried about my eshop since all purchases are attached to my nintendo account and I can redownload them, the only thing I was concerned about are my badge arcade badges.
