Is the blue falcon a hacked item?

I recently asked Storm about this and other "half-hacked" items, since I have noticed that this and other topics about these items aren't getting locked. My question to Stormcommander was specifically about the items listed here as being "only available by hacking but are not hacked items."

Storm's thought on the matter:
It's complicated because if they're in the game no one can really prove that Nintendo hasn't or won't "release" them. So if they're in the game and can be ordered from the catalog, I don't think they would be against the rules.

In other words, treat these items like the ABD's you see for sale every now and then in the auction house section of the forum. Of course they came into existence through hacking, but they're there now. It is impossible to prohibit the sale of duped items, since it is impossible to prove which items have been duped, therefore the sale of these items has to be allowed.

That's like saying moving boxes or sold out signs aren't hacked because they're in the game. No, if there's no legitimate way to obtain it in the game, it is hacked. It doesn't have to be HDLC to be a hacked item.

There is no legit way to get it. Yet. Nintendo will more than likely send it out in the mail over Wi-Fi like they do DLC.

It's in the game's code. That means that it's not DLC. It already exists in the game, but there just isn't a way to get it. Kinda like Darkrai, Shaymin, and Arceus in Pok

I agree that items that are obtained through hacking should be considered hacked items. That said, I can see what Storm is saying. These items were included in the game code by Nintendo. There's even some weird items, like the invisible chair and invisible couch, which were simply put in to have texture maps added later, but there in the game code. And for that reason, they aren't items specifically created by hackers, taking up a hex address where no item previously existed. They were and always will be in the game.

The point is this: this thread hasn't been locked and won't be locked. It is allowed on TBT.
